ANNUAL WATER WITHDRAWAL REPORTING LAW

Entities capable of withdrawing more than 100,000 gallons per day must report well use date to Dec

New Water Resources Law effective February 15, 2012

On August 15, 2011, Governor Cuomo signed a new law that will further protect New York's waters, including the Great Lakes, by requiring a DEC permit for
entities having the capacity to withdraw 100,000 gallons or more per day of surface or groundwater.

The law also requires statewide registration of existing agricultural withdrawals that are greater than 100,000 gpd (30 day average) and major basin water diversions
of greater than 1,000,000 gpd.

This law becomes effective February 15, 2012,
but no applications for non-public water supplies will be required until implementing regulations have been enacted.

Current Reporting Requirements

Any person or entity having the capability to withdraw more than 100,000 gallons per day of surface or groundwater must file an annual report with the New York
State Department of Environmental Conservation (NYSDEC).

  • Each annual report shall be submitted to NYSDEC by February 1st of the following year
  • Annual reports must include twelve months of data
  • A reporting fee of $50.00 payable to NYSDEC must be submitted with each annual report except:
  • No fee is required for withdrawals for agricultural and public water supply purposes
  • Each report shall include:
              * the water source, its location, and capacity
              * the amount of water withdrawn, including the daily average for each month and the peak (maximum) day amount for each month
              * a description of the use for which the water is withdrawn
              * estimated amounts of water to be returned to the environment or wastewater system, and the location and methods of return

  • Withdrawals which are exempt from reporting are:
              * those where annual withdrawal amounts are already reported directly to the Region 1 (Long Island) DEC office
              * those for fire suppression or other emergencies
              * those for non-extractive geothermal heating/cooling systems ("closed loop")
              * reclaimed wastewater withdrawn for reuse
